How long do I have to file a personal injury claim in Ontario?

Most injury claims have a two-year deadline from the date you knew, or reasonably should have known, you had a claim, under the Limitations Act, 2002. Some situations are far shorter. A fall on snow or ice on private property needs written notice within 60 days, and an injury on city property needs notice to the municipality within 10 days. Children generally have until age 20. Because these deadlines are easy to miss, it is best to call as soon as you can.

Do I have a case if the accident was partly my fault?

Often, yes. Ontario uses comparative fault, so your compensation can be reduced by your share of responsibility rather than barred outright. For dog bites the owner is strictly liable, though your award can still be reduced if your own actions contributed. The only way to know is to have the facts reviewed.

After a car accident, can I get help even if it might have been my fault?

Yes. Ontario's accident benefits are no-fault, so your own insurer pays for medical care, rehabilitation and attendant care regardless of who caused the crash. Suing the other driver for pain and suffering is a separate question and depends on fault and on meeting the Insurance Act threshold. We handle both sides of the claim.

What can I be compensated for after an injury?

Depending on your case, compensation can include pain and suffering, past and future lost income, the cost of treatment and care, attendant and housekeeping help, out-of-pocket expenses, and home or vehicle modifications. Family members may have their own claim under the Family Law Act for their losses and for loss of guidance, care and companionship.

Yes. James Moon is fully bilingual in Korean and English, so you can explain what happened in the language you are most comfortable with and follow every step of the claim without anything being lost in translation.
